Lohan’s Plea Deal

Lindsay Lohan reached a plea deal on misdemeanor drunken driving and cocaine charges that calls for her to spend one day in jail, serve 10 days of community service and complete a drug treatment program. She was also placed on 36 months probation, is required to complete an 18-month alcohol education program, pay hundreds of dollars in fines and must complete a three-day county coroner program in which she’ll visit a morgue and talk to victims of drunken drivers.”It is clear to me that my life has become completely unmanageable because I am addicted to alcohol and drugs,” Lohan said in a statement released by her publicist, Leslie Sloane Zelnik. She said she did things she was ashamed of. “I broke the law and today I took responsibility by pleading guilty to the charges in my case.”"Shes getting what everyone else would get,” Deputy District Attorney Danette Meyers said after an hourlong hearing in Los Angeles County Superior Court Judge H. Chester Horn Jr.’s courtroom. “If Lohan were to be convicted of another DUI, she would receive a mandatory 120-day jail sentence,” Meyers said. “If she violates her probation in any way,” Meyers added, “she could face even more time behind bars: up to a year on each of the drunk-driving and cocaine charges and 90 days on the reckless-driving charge.”"If she violates, it really is up to the judge to determine the specific sentence,” Meyers said. Lohan has until Jan. 18, 2008, to complete her jail time, community service and residential drug-rehabilitation program. She must also show proof of enrollment in the 18-month alcohol-education program required of all second-time drunken-driving offenders by that January date.”No matter what I said when I was under the influence on the day I was arrested, I am not blaming anyone else for my conduct other than myself. I thank God I did not injure others. I easily could have,” Lohan’s statement went on. Lohan was charged with seven misdemeanors stemming from two drunken-driving arrests in the last four months. More serious felony drug charges were not filed, prosecutors said, because tests showed there wasn’t enough cocaine on her to warrant them. Attorney Blair Berk entered pleas on Lohan’s behalf: she pleaded guilty to two counts of being under the influence of cocaine; no contest to two counts of driving with a blood-alcohol level above .08 percent and one count of reckless driving. Two counts of driving under the influence were dropped. The judge sentenced Lohan to 96 hours in jail, the mandatory minimum for a second drunken-driving offense. Lohan was given credit for 24 hours already served, and she elected to complete 10 days of community service instead of 48 hours behind bars, an option available to all two-time DUI offenders. “She still must serve the balance of her sentence, 24 hours, in city or county jail,” Meyers said.

Richie Serves 82 Minutes

Nicole Richie quietly went to jail to serve her sentence for DUI while the spotlight was on Lindsay Lohan. Richie checked herself into Lynwood jail, where Paris did her time, and she left a free woman after 82 minutes. According to the official website of the Los Angeles Sheriff’s Dept., Richie checked in at 3:15 PM and was released at 4:37 PM. She was assigned to a cell for only 35 minutes. Richie was sentenced to four days in jail for driving the wrong way on a Los Angeles freeway while under the influence. She was given credit for 1 day because she was in jail for 6 hours after her arrest. A Sheriff’s source says Richie was routinely processed and released according to normal operating rules. Overcrowding was a major factor in her early release.The Sheriff’s Department released a statement regarding the 82-minute incarceration of Nicole Richie:”On August 23 2007, at 3:15 PM Miss Nicole Camille Richie reported to CRDF and surrendered herself following a July 27 arrest, she was sentenced to serve 96 hours in County Jail. Miss Richie was accompanied by her attorney, Shawn Chapman Holley and her boyfriend Joel Madden. Miss Richie was booked and processed into the jail system. Miss Richie was cooperative during the process. Based on her sentence and federal court guidelines, Miss Richie was released at 4:37 PM.”

Hilton Settles Lawsuit

Paris Hilton has reached a settlement in a $10 million defamation lawsuit between her and diamond heiress-actress Zeta Graff. In the suit, Graff claimed that Hilton spread “vicious lies” about her to the media in 2005. Both sides reached an “amicable resolution,” but the details were kept confidential, according to a statement released by Graff’s attorney, Bruce Broillet.”Both parties are glad that the matter could be resolved without the time and expense of a trial,” Broillet said in the statement. In the suit, Graff claimed that Hilton spread the lies about her to the New York Post. The Post reported that Graff, who once dated Hilton’s then-fiancee, Greek shipping heir Paris Latsis, went “berserk” at a nightclub, tried to strangle Hilton and attempted to steal her diamond necklace. Graff denied the report and claimed that Hilton said, “I’m going to destroy you” after trying to oust her from the club, according to the suit. Hilton denied that she was behind the report.Hilton’s former publicist, Rob Shuter, said in a deposition that Hilton asked him to help plant the story and that he gave the paper comments, dictated by Hilton, that he attributed to himself, Hilton and anonymous sources.

No Felony Charges

Lindsay Lohan, who has seen her promising film career plummet recently, escaped felony charges when prosecutors filed seven misdemeanor counts against her stemming from two drunken-driving arrests. The district attorney charged Lohan with two counts each of driving under the influence, driving with a blood-alcohol level above .08 percent and being under the influence of cocaine and one count of reckless driving. Police found cocaine on Lohan during the arrests on May 26 in Beverly Hills and July 24 in Santa Monica. In each incident, the amounts tested were below the .05 grams required for felony charges, according to the district attorney’s office. Sources say there were also problems proving Lohan was in possession of the drug. Each of Lohan’s arrests were followed by trips to rehab. Lohan crashed her Mercedes Benz into a tree on Sunset Boulevard in May and fled the scene to seek medical treatment. Police tests revealed that a white powder in Lohan’s purse was .04 grams of cocaine. Lohan checked into the exclusive Promises rehabilitation facility after the incident. She left the facility July 13 after six weeks of treatment. She was photographed wearing an alcohol-monitoring ankle bracelet after her release. Within days, she was involved in yet another bizzarre alcohol and drug related incident. In the second case, a law enforcement source says the manner in which the cocaine was seized was questionable. In addition, the source says the amount of cocaine “didn’t meet the threshold for filing.” “The D.A. always looks at the person and the circumstances and in Lohan’s case, the fact that she was arrested twice in a short period of time actually helped her. It shows someone is struggling with an addiction problem.” “The fact that each time she was arrested, she immediately checked into a rehab facility also helped her case. Also, her age and the fact that her upbringing was extremely unstable, also worked in her favor.”

Moynahan Has Son

Bridget Moynahan and ex-boyfriend, New England Patriots’ quarterback Tom Brady are new parents. Moynahan and Brady split up late last year after a three-year relationship. Moynahan gave birth to the baby in Los Angeles, Moynahan’s publicist Christina Papadapoulos said in a statement. “Both mother and baby are doing well,” she said. Brady’s whereabouts weren’t known. He wasn’t on the field or sidelines for the first 15 minutes of practice and Patriots spokesman Stacey James said he didn’t know when Brady would rejoin the team. Brady had said earlier this week that he would like a few days off for the birth of his first child, calling the event “a very joyous, happy situation.” It was unknown if he arrived before the baby was born.

Brandy Partying

The widower of the woman who died in a car accident involving R&B singer Brandy Norwood is furious that Brandy is out partying it up while he’s still mourning his wife’s death. The attorney for accident victim Awatef Aboudihaj’s husband, Marquane Hdidou, said his client is extremely angry that he sees pictures of Brandy out clubbing so soon after the crash, which took place last December. In the upcoming court case, the judge allowed the four parties suing Brandy in civil court to combine their cases: Hdidou, his wife’s two children from a previous marriage, her parents, and Mallory Ham, the man who survived the accident. A trial date has been set for January 28 in the civil case. As for the criminal case, the investigation is still ongoing and no charges have been filed.

Lopez Wins Suit

Jennifer Lopez has been awarded nearly $545,000 in a lawsuit against her first husband, Ojani Noa, over his plans to publish a tell-all book claiming she had several affairs.A court-ordered arbitrator made the decision in Lopez’s breach-of-contract lawsuit against Noa, court papers indicated. The award includes $200,000 in damages, with the rest going for arbitration costs and attorneys’ fees.Lopez’s lawsuit claimed that Noa had violated a previous lawsuit settlement preventing him from revealing private information about their relationship.The arbitrator also decided that a permanent injunction should be awarded against Noa that would bar him from “criticizing, denigrating, casting in a negative light or otherwise disparaging or causing disparagement” to Lopez.Noa will be be directed to give Lopez or her attorney all copies of materials related to the book.The arbitration decision was disclosed when Lopez’s attorney filed papers asking a Superior Court judge to confirm the award. A hearing in the case was scheduled for Sept. 5.Noa and Lopez, married in February 1997 and were divorced 11 months later. His unpublished, ghostwritten book alleges that during that time Lopez had multiple affairs, including one with her third and current husband, Marc Anthony, court documents indicated. Her lawsuit claimed Noa offered not to publish the book in return for $5 million. In 2004, Noa sued Lopez for breach of contract, claiming she lured him into taking a $1,000-a-week managerial job at her Pasadena restaurant and then fired him five months later. Noa settled the case for $125,000 and agreed not to disclose private information about their relationship or to disparage Lopez, according to court papers. Lopez’s lawsuit claimed Noa’s book plans breached that agreement.
